Key Legal Notes
Registration is Optional
Indian wills are valid without registration under the Indian Succession Act. However, registering at the Sub-Registrar's office (INR 500–1,000 fee) prevents tampering and strengthens validity in disputes.
Hindu Succession Act
For Hindus, Buddhists, Jains, and Sikhs — self-acquired property can be willed freely. Ancestral property has coparcenary rights that limit testamentary freedom. Understand the distinction before drafting.
NRI Multi-Jurisdiction
NRIs need separate wills for assets in different countries. An Indian will should cover only Indian assets. Ensure no conflict between jurisdictions — contradicting wills can invalidate both.
